These Terms of Service ("Terms") govern the relationship between Probity ("Company," "we," "our") and you ("Client," "you," "your") when using our property management services and website (probitypm.in). By engaging our services, you agree to these Terms.
1. Services
Probity provides property management and related services in Hyderabad, Telangana, India, including but not limited to:
- Property management (verification, protection, monitoring, repairs)
- Tenant management (search, verification, rent collection, agreements)
- Legal and documentation services (title verification, mutation, PTIN, VLT)
- Property services (valuation, electricity name change, ancestral property tracing, alerts)
- Alerts and monitoring (encroachment detection, compliance management)
- Buy/rent/sell transaction assistance
Specific services, deliverables, and timelines are defined in the individual Service Agreement signed between Probity and the Client.
2. Client Obligations
- Provide accurate and complete property information and ownership documents
- Provide timely access to the property (keys, gate codes, caretaker contact)
- Respond to communications requiring your decision within reasonable timeframes
- Pay service fees as agreed in the Service Agreement
- Inform Probity promptly of any changes in ownership, legal status, or contact details
- Execute Power of Attorney where required for government processes (NRI clients)
3. Fees and Payment
- Service fees are as specified in the Service Agreement and are payable monthly/quarterly/annually as agreed
- Fees are exclusive of government charges (stamp duty, registration fees, GHMC charges, DISCOM fees) which are billed separately at actual cost
- Repair and maintenance expenses require Client pre-approval and are billed at actual vendor cost plus the agreed coordination fee
- Late payment beyond 15 days of the due date may attract a late fee of 2% per month
- Payments may be made via bank transfer, UPI, or cheque to Probity's designated account
4. Scope and Limitations
- Probity acts as the Client's authorized representative for property management and is not the owner, buyer, seller, or tenant of any property
- We provide recommendations and expert guidance but final decisions regarding property transactions, tenant selection, rent pricing, and legal actions rest with the Client
- Government processing timelines (Dharani mutations, GHMC PTIN, Sub Registrar registrations) are beyond Probity's control; we commit to diligent follow-up but cannot guarantee specific completion dates
- Property values, rental yields, and market conditions are subject to market forces; Probity does not guarantee specific financial returns
- Title verification reports represent our legal team's professional opinion based on available records; they are not a guarantee of title and do not replace title insurance
5. Liability
- Probity exercises reasonable care and professional diligence in all services
- Our total liability for any claim arising from services is limited to the total fees paid by the Client in the 12 months preceding the claim
- We are not liable for losses caused by force majeure (natural disasters, government actions, pandemics), Client's failure to provide accurate information, third-party actions (tenant damage, encroachment by third parties), or market fluctuations
- For vendor work (repairs, renovations), Probity coordinates and supervises but the vendor bears primary liability for workmanship. Major repairs include vendor warranty.
6. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. Probity will not disclose Client's personal, financial, or property information to third parties except as required for service delivery or as compelled by law. This obligation survives termination of services.
7. Termination
- Either party may terminate the Service Agreement with 30 days' written notice
- Upon termination, Probity will complete any in-progress service deliverables, return all Client documents and property keys, and provide a final account statement
- Fees for services rendered up to the termination date remain payable
- Probity may terminate immediately if the Client fails to pay fees for more than 60 days or provides fraudulent information
8. Dispute Resolution
- Any disputes arising from these Terms or the Service Agreement shall first be attempted to be resolved through mutual discussion and mediation
- If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Hyderabad
- These Terms are governed by the laws of India, and courts in Hyderabad, Telangana shall have exclusive jurisdiction

- The content on probitypm.in is for informational purposes and does not constitute legal, financial, or investment advice
- Property market data, rental ranges, and pricing mentioned on the website are indicative and subject to change
- Probity reserves the right to modify website content, service offerings, and pricing at any time
10. Amendments
Probity reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of services after modifications constitutes acceptance of the revised Terms. Material changes will be communicated to active clients via email or WhatsApp.
